These Terms of Service ("Terms") govern your use of all mobile applications and services operated by Southern MGD ("we," "us," or "our"). By using any of our apps, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms may be updated at any time. Continued use of our apps after any changes constitutes your acceptance of the revised Terms.
You must be at least 13 years of age to use our apps. If you are between 13 and 17 years of age, you must have the consent and supervision of a parent or legal guardian. By using our apps, you represent that you meet these age requirements. Our apps are currently available for users in the United States only.
Our apps use Google Sign-In for authentication. You are responsible for maintaining the confidentiality of your Google account credentials. We receive only your Google User ID, name, and email address — never your password. You are responsible for all activity that occurs under your account. Notify us immediately at privacy@southernmgd.com if you suspect unauthorized use of your account.
Some of our apps use a virtual coin system. New accounts receive free starting coins upon registration. Coins may be purchased through Google Play's or Apple's in-app purchase system. Coins have no monetary value and cannot be transferred, sold, or refunded. Coin balances are stored on our servers and linked to your Google account.
Coin purchases are subject to Google Play's and Apple's refund policies. We do not process refunds directly. All transactions are handled by the respective platform billing system. We reserve the right to modify coin pricing, feature costs, and starting balances at any time.
When you upload a photo using any of our features, you represent and warrant that: (a) you own the photo or have explicit permission from the subject to use it; (b) the photo does not depict minors in any inappropriate context; (c) you have all necessary rights to submit the photo for AI processing.
Uploaded photos are transmitted securely to our AI processing pipeline for the sole purpose of generating your requested output. Photos are not stored permanently on our servers, are not used to train AI models, and are not shared with third parties beyond our necessary processing providers (Anthropic, Replicate).
You are solely responsible for the content you upload. Southern MGD is not liable for any claims arising from your use of photos you do not own or have permission to use.
Content generated by our apps is produced using third-party AI models. You are granted a personal, non-exclusive, non-transferable license to use your generated content for personal, non-commercial purposes including sharing via messaging apps and social media.
Under current U.S. copyright law, AI-generated images without substantial human creative input may not qualify for copyright protection. Southern MGD makes no copyright claims over your generated content but cannot guarantee that outputs are free from third-party intellectual property claims. You use generated content at your own risk.
Do not use generated content to depict real people without consent, create defamatory content, infringe on trademarks or copyrights, or violate any applicable laws.
You agree NOT to use our apps to:
• Generate content that is obscene, pornographic, or sexually explicit
• Create images that depict minors in inappropriate contexts
• Generate content that harasses, threatens, or defames any person
• Upload photos of other people without their explicit consent
• Attempt to circumvent the coin system or access features without payment
• Reverse engineer, decompile, or tamper with any app
• Use automated scripts or bots to interact with any app
• Generate content that promotes violence, hate speech, or illegal activities
• Create deepfakes or misleading images of real people
Violations may result in immediate account suspension or termination without refund of remaining coins.
OUR APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SOUTHERN MGD DOES NOT WARRANT THAT THE APPS WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. AI-GENERATED CONTENT MAY BE IMPERFECT, UNEXPECTED, OR UNSUITABLE FOR YOUR INTENDED PURPOSE. YOU USE OUR APPS ENTIRELY AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOUTHERN MGD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR APPS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF OUR APPS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
We reserve the right to modify, suspend, or discontinue any app or any part of it at any time, with or without notice. We may update these Terms at any time by posting the revised version at this URL. Your continued use of our apps after changes are posted constitutes acceptance of the revised Terms.
We may terminate or suspend your account at any time for violations of these Terms, with or without prior notice. Upon termination, your right to use our apps ceases immediately and any remaining coin balance is forfeited.
These Terms are governed by the laws of the State of Alabama, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Mobile County, Alabama.
